The Differences Between IEPs and 504 Plans

An Individualized Education Program (IEP) and a 504 Plan are both designed to support students with disabilities, but they originate from different federal laws and serve different purposes. The primary distinction lies in whether a student requires specialized instruction or simply accommodations to access the general curriculum.

An IEP is governed by the Individuals with Disabilities Education Act (IDEA), a special education law. To qualify for an IEP, a student must have one of 13 specific disabilities defined by IDEA, and that disability must be significant enough to negatively impact their academic performance. An IEP is a detailed, legally binding document that outlines a unique educational program with specialized instruction, measurable annual goals, and related services like speech or occupational therapy. Essentially, an IEP changes what or how a student is taught to help them make academic progress.

504 Plan, on the other hand, is governed by Section 504 of the Rehabilitation Act of 1973, which is a civil rights law. It ensures that a student with a disability has equal access to the learning environment. The definition of a disability under Section 504 is broader than under IDEA; it includes any physical or mental impairment that substantially limits one or more major life activities, such as learning, reading, or concentrating. A 504 Plan focuses on providing accommodations and modifications to remove barriers. This might include extended time on tests, preferential seating, or the use of an elevator. A 504 Plan levels the playing field so the student can access the same curriculum as their peers.

In short, if a student’s disability requires a change in their educational program itself through specialized instruction, they would need an IEP. If the student can succeed in the general education classroom with accommodations that provide equal access, a 504 Plan is the appropriate tool.
