Understanding Your Child’s Legal Rights

Navigating the educational system can be complex, but three crucial federal laws establish a foundation of rights for you and your child. These laws ensure students with disabilities receive access to education, are protected from discrimination, and have their privacy respected.


🏛️ IDEA (Individuals with Disabilities Education Act)

 The Individuals with Disabilities Education Act is the nation’s cornerstone special education law. Its most important guarantee is the right to a Free Appropriate Public Education (FAPE) for every eligible child with a disability.

  • Free: This means the specialized instruction and services your child needs must be provided at no cost to you.
  • Appropriate: This is a key word. The education must be tailored to your child’s unique needs. This is achieved through the Individualized Education Program (IEP), a legally binding document that outlines specific goals, services, and supports for your child. IDEA ensures your child receives the support necessary to make meaningful progress in school.

 ♿ ADA (Americans with Disabilities Act)

The Americans with Disabilities Act is a broad civil rights law that prohibits discrimination against people with disabilities in all areas of public life. In a school setting, this means a child cannot be excluded from any program or activity because of their disability.

While IDEA focuses on the specialized academic instruction, the ADA ensures equal access to the entire school experience. This includes extracurricular activities like sports teams, school clubs, field trips, and assemblies. The school must provide reasonable accommodations to allow your child to participate. For example, if a student in a wheelchair wants to join the school choir, the school must ensure performances are held in an accessible location.


 📁 FERPA (Family Educational Rights and Privacy Act)

The Family Educational Rights and Privacy Act is a federal law that protects the privacy of student education records. This law gives parents two primary rights:

  1. The Right to Access: You have the right to inspect and review all of your child’s education records maintained by the school. This includes everything from grades and attendance to disciplinary reports and health records.
  2. The Right to Control Disclosure: Schools must have your written permission before releasing any information from your child’s record to outside parties (with some exceptions). This law puts you in control of your child’s private educational information.
